Terms &  Conditions

General

Jourday is an online Travel Service Platform that offers to users all tools needed to find, and book authentic travel experiences. Jourday offers a variety of, Package Tours (multi day tours including accommodation), Tours (Day Tours without accommodation) and activities which all three of them hereinafter “travel bites” made available either by Jourday or Partners through Jourday’s and its affiliates’ websites and related applications (hereinafter, “Website”). This Website is provided to assist travelers to find and book travel bites at a chosen destination, rating and reviewing of the travel bites and participating in interactive travel forums. References to “we”, “us”, “our”, “Jourday” refer to Jourday and Jourday’s suppliers and affiliates, to “you” and “your” are to you, the Website user using the services and contributing to the content of the Website and Jourday’s Partners to principals of the travel bites offering them through the Website.

For travel bites operated by Jourday the principal of the Travel bite is Jourday. Jourday is the seller of the services that are performed pursuant to the Travel bites (and to which Vouchers correspond), and is solely responsible for providing all such services relating thereto.

For travel bites operated by Partner (hereinafter “Jourday’s Partner”) the principal of the Travel bite is the Partner AND NOT Jourday. Partner is the seller of the services that are performed pursuant to the Travel bites (and to which Vouchers correspond), and is solely responsible for providing all such services relating thereto. For travel bites operated by Partner Jourday provides the platform to enable you to book and complete the payment of the travel bite you have chosen and is offered through our platform and thus acts solely as the mediator between you and the supplier of the Travel bite. In this case the contract for the purchased Travel bites is between you and Jourday’s Partner

The following Terms and Conditions along with information contained separately in each tour and activity in our website form the basis of your contract with Jourday Ltd, registered in England and Wales with company number 9673934 at 190 Billet Road, London, E17 5DX. There are specific well defined below differences in Terms and Conditions between travel bites operated by Jourday and Travel Bites operated by Partner which altogether consist part of Terms and Conditions.

Please read these Terms and conditions carefully as by using this Website or by booking any Travel bite with Jourday Ltd., or one of its affiliates we (including Jourday’s Partners) and you acknowledge that you:

  1. have read and understand these Terms, and
  2. accept and agree to be bound by these Terms and conditions (hereinafter, the “Contract”).

If for any reason you do not accept all of these terms and conditions, please do not use this Website or book a Travel bite. In all booking arrangements, the person making the booking shall be deemed to have accepted this Contract on behalf of the persons named or included in the booking.

We and our Jourday’s Partners may change or modify the Contract in the future, and you understand and agree that your continued access or use of this Website after such change implies that you accept the updated or modified Contract. In any time the date of the latest in force contract will be written at the top of the page containing the Terms and Conditions. Our members will be informed of changes of the Terms and Conditions either by sending the relative notice to the member’s email address included in his account or by placing a notice on our Website. We would like to ask you to visit this page from time to time to review the most current version of the Contract.

Use of the Website

For the use of this Website you ensure that:

  • You will use our Website only for lawful purposes
  • You are 18 years of age or older at the time of registering for an account and contributing content to our Website
  • All information provided by you for you and for all other persons either named or included on the booking on this Website is accurate and complete and that you have obtained the consent and permission to share the information of all other persons provided to us.
  • You have the consent and authority to make a booking on behalf of all other persons either named or included on the booking, and have communicated all necessary information to the other persons including but not limited to the Terms and conditions and information related to the travel bite as these are presented in our website.
  • Your intention of use of this website is personal and non-commercial
  • You have not previously been suspended by Jourday or otherwise banned from using the Website
  • You also agree not to interfere with, damage or disrupt any part of our Website, any equipment or network on which our Website is stored; or any software used in the provision of our Website.
  • You are responsible for making all arrangements for you to have access to our Website.
  • If we determine that a breach of these terms has occurred, we may take such action as we deem appropriate, including immediate, temporary or permanent withdrawal of your right to use our Website further legal action against you and/or disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

User account and password

To use some features in our website you will need to create an account, password and provide information about yourself. You are responsible for maintaining the confidentiality of your account and password (hereinafter, the “login credentials”). You must not disclose to any third party your login credentials. You agree that you are responsible for all actions that occur in connection to your account and neither Jourday nor any of our affiliates will have any liability to you or others for any unauthorized use of your account including but not limited to transactions made by using your login credentials. The unauthorized use of your login credentials could cause you to incur liability to Jourday and/or other users. Your account is for your personal, non-commercial use only.

If by any means it has come to your attention an unauthorized use of your account you must notify us by email at customer_service@jourday.com or here and change your password.

You may terminate your account at any time by closing your account. If you close your account, we may continue to display your previously published Content and are under no obligation to remove any of your Content.

We have the right to disable any user account or password, if in our reasonable opinion you have failed to comply with any provision of these terms.

Booking process

The first named person on the booking (hereinafter “lead name”) must be 18 years old or over and authorized to make the booking on the basis of the booking conditions by all persons named or included on the booking. By submitting the booking to us you as the Lead name person confirms that you are authorized and 18 years old or over and you acknowledge that you accept the practices described in our privacy policy and this contract. The Lead name person is responsible for ensuring the accuracy of the personal details or any other information supplied in respect of yourself and any other person travelling on the booking and for passing on any information regarding the booking or any changes made in relation thereto, to all persons travelling on such booking, including but not limited to information on schedule changes or copies of booking confirmation. The Lead name person is responsible for making all payments due to us.

For Travel bites operated by Jourday provided that there is availability for the travel bite you have booked and we have received all applicable payments, we will confirm your booking by issuing a payment confirmation, voucher and confirmation invoice. Full instructions will be given with the voucher as to how they should be redeemed. The invoice will be sent to the lead name. You are requested to check this invoice carefully and contact us in written via email immediately if any information which appears on the confirmation or any other document appears to be incorrect or incomplete as it may not be possible to make changes later.

For Travel bites operated by Partner provided that there is availability for the travel bite you have booked and we have received all applicable payments, we will confirm your booking by issuing a payment confirmation and voucher which will be sent to you. Full instructions will be given with the voucher as to how they should be redeemed. The invoice corresponding to the voucher (or vouchers) will be provided by Partner.

Payment process

Full payment is required at the time of booking. In case full payment is not received at the time of booking, we and Jourday’s Partners have the right to treat your booking as cancelled by you. In this case, the cancellation charges set out below will be payable. No refunds are available once a travel bite has commenced.

The website price for a travel bite refers to the fee for the travel bite and VAT and do not include unless listed in the “Inclusions” other costs such as but not limited to local taxes, port charges, park fees, customs, tips/gratuities, passport and visa fees, baggage and personal insurance, any beverages or food. The value of the transaction may be subject to taxes, duties, foreign transaction, currency exchange or other fees. There is no charge or service fee for processing credit or debit card payments from Jourday. Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on the website, and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees.

Though you can select to view your Travel bites in your preferred currency from options provide through Jourday for ease of reference, the final transaction will be processed in euro. The approximate currency conversion shown with our currency calculator is based on current information from multiple sources. Jourday does not, and cannot, verify the actual conversion rates utilized either by the above-mentioned sources or by your card issuer or bank.

The Contract

You hereby consent as we do to the exclusive jurisdiction and venue of courts of England and Wales only for all disputes arising out of or relating to the use of this Website (and whether or not involving any personal injury).

For travel bites operated by Jourday a binding contract between you and us comes into existence when you have received our confirmation invoice. Also, you hereby consent that English Law (and not other) apply to this contract.

For travel bites operated by Jourday’s Partner a binding contract between you and Jourday’s Partner comes into existence when you have received our confirmation payment and voucher. The invoice corresponding to the voucher (or vouchers) will be provided by Jourday’s Partner. You hereby consent that for the service provided as described at the relative travel bite web page and the voucher provided for the purchase of this travel bite the Jourday’s Partner company country establishment Law (and not other) apply to this contract.

Medical and Health Conditions

You, the Lead name person of this booking, acknowledge and accepts that is full responsible to assess your and for the persons named or included in the booking suitability and capability to participate in the chosen travel bite. We and Jourday’s Partner encourage you and the rest of the people named or included in the booking to seek a physician’s advice regarding necessary or advisable medical actions, medical precautions, or other medical concerns regarding the entirety of your participation in the chosen travel bite.

It is essential to inform us by email at customer_service@jourday.com or here before you confirm your booking if you or any person who will be included in the booking for any medical condition or disability which may affect your arrangements or has any special requirements as a result of any medical condition or disability (including any which affect the booking process) so we can assist you in considering the suitability of the arrangements and/or making the booking. For any medical condition or disability develops after your booking and may affect your arrangements you are requested to inform us promptly at customer_service@jourday.com or here. If we can’t accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking or the condition / disability develops after booking, cancel when we become aware of these details. Once a travel bite has been confirmed medical circumstances for which we were not aware before the booking took place will not be considered as exceptions in fees applicable according to cancellation policy.

Travel bite Prices, surcharges and taxes

Prices listed on the Website are accurate at the date published, but we reserve the right to change any of those prices from time to time. However we guarantee that the price quoted on your booking confirmation for travel bites will not change unless you make an amendment to the booking details. For the Package Tours (multi day tours) we reserve the right to impose surcharges up to 30 days before departure due to unfavorable changes in exchange rates, increases in transportation costs, increases in local operator costs, taxes, or if government action should require us to do so.  In such cases we will absorb and you will not be charges for any amount up to 2% of the Package Tour price. If price changes after the booking confirmation and results in an increase of more than 10% of the Package Tour price you may cancel the booking within 15 days of notification of the surcharge and obtain a full refund or pay the surcharge and join your Package tour as initially scheduled.

From time to time we and Jourday’s Partner may offer reduced pricing on selected Travel bites. The reduced pricing applies strictly to new bookings, and bookings that have already been confirmed are not entitled to the reduced pricing.

Modifications and Cancellations by you

In case you would like to modify your booking once it has been confirmed please contact us via email at customer_service@jourday.com or here. Please note even though it may not always be possible to make modifications, that we will try to make the changes subject to availability, provided that notification is received by us via email from the lead name at least 7 calendar days before the cancellation windows expires. Where it is possible to do a modification upon your request we reserve the right to charge an amendment fee of 15 euro per booking for each change in addition together with any costs incurred or imposed by any of our suppliers in making the change. A modified voucher (where applicable) will be issued to you. The original voucher will then become invalid and should be destroyed. No refunds will be payable if the original voucher and not the reissued one is redeemed at the travel bite concerned. In case of the use by you in anyway of a refunded by us modified voucher and not the reissued one will be responsible for paying that refund back to us.

To cancel a booking the lead name person should contact us via email at customer_service@jourday.com or here and we will then upon receiving the request issue the cancellation invoice. Upon receiving in written by the lead name person as appearing in the initial booking the cancellation request we will then issue you with a cancellation invoice. The cancellation will only take effect from the date that we issue our cancellation invoice and may result in cancellation fees as outlined below. Amendment charges are not refundable in the event of cancellation. Wire transfer, paypal or credit card surcharges for refunding money upon cancellation in all cases except the non-refundable may occur and are fully covered by you.

In case you manage in any way to redeem the original voucher for which you have requested and we have accepted the cancellation you will be responsible for reimbursing us for the full cost of the voucher. Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total cost payable by the person(s) cancelling excluding amendment charge.

Unless a travel bite is non refundable which will clearly be described at the Travel bite description page at the time of booking the cancellation windows for each travel bite type in general is as described below unless there is an exception and a different cancellation window described at the travel bite page for the travel bite at the time of booking in which case the valid one is the one described at the travel bite page at time of booking.

Modifications and Cancellations by us

IN THE UNLIKELY EVENT THAT WE FACE UNFORESEEN CIRCUMSTANCES BEYOND OUR CONTROL OR THE MINIMUM NUMBER OF GUESTS IS NOT ACHIEVED WE AND JOURDAY’S PARTNER RESERVE THE RIGHT TO CHANGE OR CANCEL ANY OF THE FACILITIES, SERVICES OR PRICES DESCRIBED IN OUR WEBSITE AND LINKED TO A TRAVEL BITE. CHANGES ARE USUALLY MINOR AND APPLY BUT NOT LIMITED TO HOTELS, TOUR ITINERARIES, OUTDOOR ACTIVITIES AND MEANS OF TRANSPORT. WHEN A MAJOR CHANGE OCCURS, YOU WILL HAVE THE CHOICE OF EITHER:

  • ACCEPTING THE CHANGE
  • ACCEPTING A SIMILAR TRAVEL BITE PROPOSED BY US OF EQUIVALENT OR GREATER PRICE (AT THE DATE OF THE CHANGE) PROVIDED THERE IS AVAILABILITY TO OFFER YOU ONE. IN THIS CASE YOU AGREE AND ACCEPT PAYING ANY DIFFERENCE IN PRICE BETWEEN THE AMENDED TRAVEL BITE AND THE TRAVEL BITE BOOKED IN ITS PLACE.
  • BOOK ANOTHER TRAVEL BITE OF A LOWER PRICE, IF AVAILABLE, WITH A REFUND PAYABLE TO THE YOU OF THE DIFFERENCE IN PRICE; OR
  • CANCELLING YOUR TRAVEL BITE, IN WHICH CASE YOU SHALL RECEIVE A FULL REFUND OF ALL MONIES PAID FOR THE CANCELLED TRAVEL BITE

THE OPTIONS SET OUT ABOVE REPRESENT THE FULL EXTENT OF OUR LIABILITY TO YOU IN THE EVENT OF A SIGNIFICANT CHANGE OR CANCELLATION OF YOUR ARRANGEMENTS JOURDAY AND JOUIRDAY’S PARTNER IS NOT RESPONSIBLE FOR ANY INCIDENTAL EXPENSES OR CONSEQUENTIAL LOSSES THAT YOU MAY HAVE INCURRED AS A RESULT OF THE CANCELLED OR MODIFIED BOOKING SUCH AS VISAS, VACCINATIONS, NON-REFUNDABLE FLIGHTS OR RAIL, NON-REFUNDABLE CAR PARKING OR OTHER FEES, LOSS OF EARNINGS, OR LOSS OF ENJOYMENT, ETC.

FOR PACKAGE TOURS AND SAILING MULTI-DAY TOURS DEPENDENT ON A MINIMUM NUMBER OF PERSONS BOOKING IT WE AND JOURDAY’S PARTNER RESERVE THE RIGHT TO CANCEL IT IF THAT NUMBER IS NOT ACHIEVED. HOWEVER, WE WILL NOT CANCEL YOUR PACKAGE TOUR LESS THAN 4 WEEKS AND SAILING MULTI-DAY TOUR LESS THAN 8 WEEKS BEFORE THE SCHEDULED DEPARTURE DATE EXCEPT FOR REASONS OF FORCE MAJEURE (AS DEFINED BELOW) OR FAILURE ON YOUR PART TO COMPLETE THE FULL PAYMENT, OR ANY OTHER REASON BEYOND OUR CONTROL. WHERE WE CANCEL YOUR BOOKING BEFORE THE DATE YOU COULD REDEEM THE PACKAGE TOUR WHERE YOU ARE NOT IN BREACH OF THESE BOOKING CONDITIONS AND OTHER THAN FOR REASONS OF FORCE MAJEURE, WE WILL OFFER YOU THE SAME CHOICES DESCRIBED ABOVE WHEN MAJOR CHANGES OCCUR.

YOU MUST ACKNOWLEDGE THAT SOME TRAVEL BITES LIKE BUT NOT LIMITED TO THE ADVENTURE STYLE REQUIRES A CERTAIN DEGREE OF FLEXIBILITY DUE TO UNEXPECTED CIRCUMSTANCES THAT MIGHT INCUR. FOR THIS REASON WE URGE TRAVELERS TO PROCURE TRAVEL INSURANCE THAT WILL COVER THEM FOR ANY UNFORESEEN EVENT.

FORCE MAJEURE INCLUDE ANY EVENT WHICH WE OR OUR SUPPLIER OF THE SERVICE(S) IN QUESTION OR JOURDAY’S PARTNER COULD NOT EVEN WITH ALL DUE CARE, FORESEE OR PREVENT SUCH AS (AS EXAMPLE BUT NOT LIMITED) WAR, THREAT OF WAR, RIOTS, CIVIL DISTURBANCES, INDUSTRIAL DISPUTES, ACTUAL OR THREATENED TERRORIST ACTIVITY AND ITS CONSEQUENCES, NATURAL OR NUCLEAR DISASTERS, FIRE, EPIDEMICS, HEALTH RISKS AND PANDEMICS, ACTS OF GOD, UNAVOIDABLE AND UNFORESEEABLE TECHNICAL PROBLEMS WITH TRANSPORT FOR REASONS BEYOND OUR CONTROL OR THAT OF OUR SUPPLIERS, CLOSED OR CONGESTED AIRPORTS OR PORTS, HURRICANES AND OTHER ACTUAL OR POTENTIAL ADVERSE WEATHER CONDITIONS, AND ALL SIMILAR EVENTS OUTSIDE OUR CONTROL.

Complaints and Questions

Should you have any question in regards to a travel bite before you complete your booking please send your question to the customer_service@jourday.com or here. Should you have any question after you receive your booking confirmation and at the time you are at the destination you are requested to contact the representative/supplier mentioned on your voucher. Should you have any complaint in regards to a travel bite you have redeemed please write to us within 21 days from the day the incident occurred by providing booking reference full contact details at customer_service@jourday.com or here. In all cases only the lead name person should write to us. Failing to follow the complaints procedure, right to claim any compensation you may otherwise have been entitled to may be affected or even lost as a result.

Our Liability to you

THE CONTENT, TRAVEL BITES, SOFTWARE AND SERVICES OF THIS WEBSITE MAY INCLUDE ERRORS OR INACCURACIES INCLUDING TRAVEL BITE AVAILABILITY AND PRICES. WE DO NOT GUARANTEE THE ACCURACY OF AND YOU CAN’T WITHHOLD US LIABLE FOR ERRORS OR OTHER INACCURACIES RELATING TO WEBSITE CONTENT AND SERVICES INCLUDING BUT NOT LIMITED TO GENERAL TRAVEL BITE DESCRIPTION, AVAILABILITY, PRICES, INCLUSIONS AND EXCLUSIONS, PHOTOGRAPHS, REVIEWS AND RATINGS, ETC.  ANY VIEWS SUBMITTED BY OUR WEBSITE USERS DO NOT NECESSARY REFLECT OUR VIEWS AND OPINIONS.

WE MAKE NO REPRESENTATIONS ABOUT SUITABILITY OF THE CONTENT, TRAVEL BITES, SOFTWARE OR SERVICES OF THIS WEBSITE FOR ANY PURPOSE, AND THE INCLUSION OR OFFERING OF CONTENT, TRAVEL BITES, SOFTWARE OR SERVICES OF THIS WEBSITE DOES NOT CONSTITUTE ANY ENDORSEMENT OR RECOMMENDATION OF SUCH CONTENT, TRAVEL BITES, SOFTWARE OR SERVICES BY US. ALL CONTENT, TRAVEL BITES, SOFTWARE OR SERVICES OF THIS WEBSITE ARE PROVIDED “AS IS” WITHOUT ANY WARRANT OF ANY KIND. WE DISCLAIM ALL WARRANTIES AND CONDITIONS THAT HIS WEBSITE, IT’S SERVERS OR ANY EMAIL SYSTEM FROM US ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. JOURDAY MAKES ARRANGEMENTS WITH INDEPENDENT PARTIES (“THIRD PARTY SUPPLIERS”) AND JOURDAY’S PARTNERS TO PROVIDE YOU WITH THE TRAVEL SERVICES AND OTHER SERVICES YOU PURCHASE OR WHICH FORM THE COMPONENT PARTS OF YOUR PRODUCT TOUR. THIRD PARTY SUPPLIERS MAY ALSO ENGAGE THE SERVICES OF LOCAL OPERATORS AND/OR SUB-CONTRACTORS FOR THE PROVISION OF TRAVEL SERVICES THAT FORM PART OF THE TRAVEL BITE(S). ALTHOUGH JOURDAY TAKES ALL REASONABLE CARE IN SELECTING THIRD PARTY SUPPLIERS, JOURDAY IS UNABLE TO CONTROL THIRD PARTY SUPPLIERS AND DO NOT SUPERVISE THIRD PARTY SUPPLIERS AND THEREFORE CANNOT BE RESPONSIBLE FOR THEIR ACTS OR OMISSIONS. THE TRAVEL BITES AND OTHER SERVICES PROVIDED ARE SUBJECT TO THE CONDITIONS IMPOSED BY THESE SUPPLIERS AND THEIR LIABILITY IS LIMITED BY THEIR TARIFFS, CONDITIONS OF CARRIAGE, TICKETS AND VOUCHERS AND INTERNATIONAL CONVENTIONS AND AGREEMENTS THAT GOVERN THE PROVISION OF THEIR SERVICES. THESE MAY LIMIT OR EXCLUDE LIABILITY OF THE SUPPLIER. YOU ACKNOWLEDGES THAT THIRD PARTY SUPPLIERS OPERATE IN COMPLIANCE WITH THE APPLICABLE LAWS OF THE COUNTRIES IN WHICH THEY OPERATE AND JOURDAY DOES NOT WARRANT THAT ANY THIRD-PARTY SUPPLIER IS IN COMPLIANCE WITH THE LAWS OF YOUR COUNTRY OF RESIDENCE, OR ANY OTHER JURISDICTION. TO THE FULL EXTENT PERMITTED BY LAW JOURDAY AND JOURDAY’S PARTNER IS NOT LIABLE AND WILL NOT ASSUME RESPONSIBILITY FOR ANY CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES ARISING OUT OF INCONVENIENCE, LOSS OF ENJOYMENT, UPSET, DISAPPOINTMENT, DISTRESS OR FRUSTRATION, WHETHER PHYSICAL OR MENTAL, RESULTING FROM THE ACT OR OMISSION OF ANY PARTY OTHER THAT JOURDAY AND ITS EMPLOYEES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR AND JOURDAY’S PARTNER LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE (OR THAT OF OUR EMPLOYEES, AGENTS OR DIRECTORS); OR FRAUD OR FRAUDULENT MISREPRESENTATION; OR ANY LIABILITY WHICH MAY NOT BE LIMITED OR EXCLUDED BY LAW PROVIDED. THE TRAVELER ACKNOWLEDGES THAT THE NATURE OF SOME TRAVEL BITES ARE ADVENTUROUS AND IT INVOLVES A SIGNIFICANT AMOUNT OF HEALTH/SAFETY RISK RELATED TO PARTICIPATION IN OUTDOOR ADVENTURE ACTIVITIES. YOU ACCEPT THAT YOU ARE AWARE OF THE PERSONAL RISKS ATTENDANT UPON SUCH TRAVEL BITES AND YOU HEREBY ASSUME ALL SUCH RISK AND RELEASE US FROM ALL CLAIMS AND CAUSES OF ACTION ARISING FROM ANY DAMAGES OR INJURIES OR DEATH AS A RESULT OF YOUR PARTICIPATION IN SUCH TRAVEL BITES.

IF YOU ARE A BUSINESS USER, WE WILL NOT BE LIABLE TO YOU FOR ANY LOSS OF PROFIT, SALES, BUSINESS OR REVENUE, BUSINESS INTERRUPTION, LOSS OF ANTICIPATED SAVINGS, LOSS OF BUSINESS OPPORTUNITY, GOODWILL OR REPUTATION OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE.

IF JOURDAY OR JOURDAY’S PARTNER IS FOUND LIABLE FOR ANY LOSS OR DAMAGE THAT ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF OUR WEBSITES OR YOUR BOOKING OR USE OF TRAVEL BITE OR SERVICES MADE AVAILABLE THROUGH OUR WEBSITE, THEN JOURDAYS’ LIABILITIES WILL IN NO EVENT EXCEED, IN THE AGGREGATE, OF THE TRANSACTION FEES PAID TO JOURDAY (EXCLUDING AMENDMENT CHARGES) BY OR ON BEHALF OF THE PERSON(S) AFFECTED IN TOTAL. THIS MAXIMUM AMOUNT WILL ONLY BE PAYABLE WHERE EVERYTHING HAS GONE WRONG AND YOU HAVE NOT RECEIVED ANY BENEFIT AT ALL FROM YOUR ARRANGEMENTS.

Behavior and damage

If you (or any person named or included in the booking confirmation) commit any illegal act when using a travel bite or if in our reasonable belief your behavior is disruptive, threatening or abusive, causes unnecessary inconvenience or is causing or likely to cause damage to property, danger, distress or upset, disturbance or annoyance to others or puts any other traveler or our staff in any risk or danger, on the telephone, in writing or in person, we may terminate your travel bite arrangements affecting you and the persons named or included in the booking confirmation without any liability on our part. In any of these circumstances no refunds or compensation will be paid to you or the persons named or included in the booking confirmation and we will not be liable for any costs or expenses you incur.

You accept responsibility for any damage or loss caused by you or any person named or included in the booking confirmation. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made direct to our supplier or to us as soon as possible. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against us and all costs incurred by us (including our own and the other party’s full legal costs) as a result of your actions (or any person named or included in the booking confirmation). You should ensure you have appropriate travel insurance to protect you (or any person named or included in the booking confirmation) if this situation arises.

Any accommodation we or Jourday’s partner arrange for you must only be used by those people named on your Booking Confirmation. You are not allowed to share the accommodation or let anyone else stay there.

You agree to defend and indemnify Jourday and all our directors, employees, suppliers and agents and Jourday’s Partners from and against any liabilities of any kind or nature including but not limited to reasonable legal and accounting fees, arising out of or related to:

  • your breach of this Agreement or the documents referenced herein;
  • your violation of any law, rule, regulation or guideline;
  • your violation, infringement or misappropriation of the rights of a third party, including without limitation any rights of publicity or privacy;
  • your use of this Website;
  • your booking or use of any travel bite(s) obtained through this Website; or
  • your negligence or willful misconduct.

Insurance

We and Jourday’s partner consider adequate travel insurance to be essential. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.

Financial security

If you have made a booking for package Tours operated by Jourday, all monies you pay us are protected by the Trust Account which we operate for this purpose. This means that in the unlikely event of our insolvency you will receive a full of refund of any money you have paid to us for such booking. For all other bookings, which are not considered as package holidays according to Package Holidays and Package Tours Regulations 1992 the financial protection referred to above does not apply.

Passports and Visas

It is your responsibility to ensure that you have the correct passport and visas to gain entry to any country/attraction (where applicable). We and Jourday’s Partner cannot accept any liability if you are refused entry to any country or attraction etc. as a result of your failure to do so.

Privacy Policy

All personal information that you provide will be held confidentially within our secure database and will not be passed to third parties unless you give permission to do so or it is necessary to do so in order to provide you with the services you have booked. Where payment is processed via credit card, credit card numbers are not retained on our database. We understand that data protection is important to you. As a UK company, we are already subject to data protection laws including the European data protection law called the General Data Protection Regulation (GDPR) which became effective on May 25, 2018 and affects all companies who process personal data of individuals in the EU.
